Board of Supervisors Appoints County Director of Environmental Management

The El Dorado County Board of Supervisors appointed Greg Stanton as Director of Environmental Management, effective immediately.

“Greg brings to this new position more than 14 years with El Dorado County in the area of environmental management and more than 17 years in the public sector,” said Chief Administrator, Don Ashton. “His exceptional leadership skills and deep commitment to the County will help enhance the public health, safety and environment for all residents. We are very fortunate to have his expertise to help guide this County through environmental management issues.”

Recently the County reorganized what is now Community Development Services to include directors of three primary departments, of which Environmental Management is one. Stanton previously was Interim Director during the restructuring and while an open recruitment for the Director position was conducted. Stanton has held positons within the County as Solid Waste Supervisor, Environmental Health Manager, Deputy Director of the Environmental Management division, and Division Director of Environmental Health. He is a registered Environmental Health Specialist with the State.

In addition to his work in the public sector, Stanton has more than 22 years in the private sector in fields directly related to environmental management programs, such as food safety and food facility operations, potable water, recreational water safety and wastewater treatment plant operations.

“I’m delighted to continue the path I’ve been on with the County for so many years,” said Stanton. “I’m grateful for the opportunity to keep doing what I’m passionate about in the hopes of making a positive difference for the residents of El Dorado County.”

Stanton holds a Bachelor of Science degree in Biology from San Diego State University.

Roger Trout appointed as Director of Planning and Building

(PLACERVILLE, CA. August 3, 2017) – The El Dorado County Board of Supervisors appointed Roger Trout as Director of Planning and Building, effective immediately.

“With more than 27 years of experience in nearly every capacity of the County’s Planning and Building functions, Roger’s expertise of El Dorado County is particularly valuable as we make many of our processes more streamlined and easier for the public to access,” said Chief Administrator, Don Ashton.

Trout previously served as Interim Director during the restructuring and while an open recruitment for the Director position was conducted.

Trout began his career with El Dorado County in 1990 when he was hired as an assistant planner. He was promoted to senior planner where he served for seven years and then principal planner for another seven years. He was promoted to Development Services director in 2008, serving in that capacity for five years before he was promoted to the director of the Development Services Division position in 2013.

“I’m honored to serve in this capacity for the residents of El Dorado County,” said Trout. “I have a deep interest in and understanding of local planning and building regulations and codes, as well as those at a state and federal level that impact how we provide services through this department. I look forward to bringing my experience and talents to bear as the County moves toward its future.”

Trout holds a Bachelor of Science degree in Environmental Planning and Management from the University of California, Davis.

Tree Removal Program in South Lake Tahoe

The term “defensible space” refers to the area between a house and an oncoming wildfire where the vegetation has been managed to reduce the wildfire threat. Fortunately for Lake Tahoe Basin homeowners, there are a variety of resources available to assist in creating defensible space.

Defensible Space – Tree Removal

Contact your fire protection agency for permitting and a complete defensible space evaluation. The Living with Fire Guide for the Lake Tahoe Basin is the authoritative guide for vegetation management and wildfire preparedness on properties in the Tahoe Basin. All environmental and fire agencies in the Region agree on the recommendations in this guide, which is published by the University of Nevada, Cooperative Extension.

On the South Shore, structures located within the City of South Lake Tahoe follow the Tahoe Regional Planning Agency’s tree removal permit process. A homeowner can apply for a tree removal permit online at: https://aaweb.trpa.org/. The application can also be obtained at the TRPA front counter, or by calling (775) 588-4547. A $53 non-refundable filing fee is due with the application. A TRPA forester will visit the property to assess the trees and issue a permit for any marked trees.

Five things that will Give You More Wisdom

1.      You don’t know everything

Don’t be too worried about figuring it all out. An Indian proverb tells of a group of blind men arguing over what an elephant’s like. One who touched the elephant’s side said it was like a wall. Another touched one of the elephant’s legs and said it was like a tree. A third man touched the elephant’s tail and said it was like a rope.

Who was right? They were all right, but none were seeing the whole picture. There are things mankind simply doesn’t yet know. Fortunately, from a business perspective, no matter how confident they may appear, you can expect there’s a lot your competitors also don’t know.

2.      Some people are rude

According to people who study Tom Cruise movies, a lot of them share common themes. One is that people who seem like adversaries early on often end up being great friends and allies as the story progresses. Another is the reverse, that a true villain emerges as somebody's social veneer falls off.

There’s a lot of truth to this in life and a reason not to put too much stock in superficial first impressions. Somebody might appear rude and be an awesome person if you give them a chance. Somebody else might have great manners and actually be the one you should watch out for.

3.      You can tell yourself to be happy

You’re not a slave to your feelings. Struggle with negative emotions? We all do, but you can actually train your brain to be more positive by choosing to think more positive thoughts. Scientists have observed that when you learn to look at things from a more positive viewpoint, you create new neuropathways in your brain that over time make you happier overall.

4.      What makes you different can be what gives you the edge

Most of us don’t like to be different. But sometimes the things that make us unique are the things that give us an edge in life and in business. Some of my most successful decisions have come from things I observed around me that seemed obvious to me, but that weren’t really on anybody else’s radar.

For example, I was at the gym in the middle of the night the other day – I’m at my most energetic late – and after a good workout I felt a little disappointed I couldn’t use any of my extra energy on business calls, given it was 2 am. Then, I realized I should find some business opportunities in a country where they're awake at 2 am my time, so now I’m looking forward to exploring ventures in Australia.

5.      Our society is probably wrong about a lot

I watched a cute video recently of a little girl shouting at a guy going on an early morning jog, “You’re winning! You’re winning at life!” And it made me think, is that what it means to win at life? To be diligent about your workout routine? Is it to make a lot of money? Is it about impressing other people? Our society would give a resounding “yes” to all of the above.

There’s nothing wrong with any of those things, but before going along with the crowd it’s worthwhile to consider how much our own society has gotten wrong in the last couple hundred years. There are many things that "everybody believes," but it's important for us to ask whether "everybody" is actually right.

Internet Based Efforts Makes Counties' Public Engagement More Effective

Technology can help counties change the who, when, where and how of educating and engaging local residents. Whether it’s economic development, housing, immigrant integration or a contentious local issue, counties are experimenting with different kinds of technology to enhance their engagement of the public. Whether the goal is to broaden participation, accelerate progress on decision making or create a “safe space” for feedback on tough issues, online tools can help your county achieve those goals, and present an important opportunity to expand the number and diversity of voices providing input to local decision-making.

According to Pew Research Center, approximately 70 percent of American adults used at least one social media platform to connect with each other, share information and read news. Additionally, nearly 40 percent of adults get their news from online platforms. With these numbers trending upward over the last decade, online engagement and communication are more important than ever to counties across California.

Benefits of Online Engagement

Counties are seeing many benefits of online engagement including:

  • -- The ability to reach diverse audiences – online options allow residents to provide input at their convenience (location and time of day);
  • -- More informed participants – counties are able to provide essential background information with varying levels of detail for different issues and audiences, keep information up to date and respond to questions as they arise;
  • -- Broader range of perspectives – online tools present opportunities to include broader (and possibly more moderate) perspectives than public meetings that are often attended primarily by passionate advocates; and
  • -- More sustained engagement – counties can create a transparent repository of all public input which can be drawn on for later use to develop an audience of informed and interested residents cross issues and agency departments.

ILG Offers Free Technology to Enhance Public Meetings

ILG also offers local agencies the use of handheld wireless devices for a process known as keypad polling. These devices are typically used in a meeting to gather instantaneous responses from individual participants. When combined with dialogue, this technology allows participants to anonymously select or prioritize options and then immediately view the group’s collective judgment or the opinions of different subsets of participants. Measure E Policies Unconstitutional Rules Court

In resolving a lawsuit challenging Measure E, El Dorado County Judge Warren Stracener has ruled that Measure E imposed exactions on new development that violate constitutional fair share requirements.

The “no-growth” proponents of Measure E promised voters that the initiative would make an affected development project pay for the full cost of improvements to regional roads and Highway 50 to serve 10 to 20 years of projected cumulative growth, divert impact fees from designated road projects to be spent in the area where the fees were collected, and allow fees to be used for road maintenance. Proponents could not deliver on these promises, however, because the power of the initiative does not authorize voters to enact laws that are unconstitutional or violate state law.

A long list of organizations including the El Dorado County Farm Bureau, El Dorado County Chamber of Commerce, El Dorado Hills Chamber of Commerce, Deputy Sheriffs’ Association, El Dorado Winery Association, El Dorado County Taxpayers Association, El Dorado County Republican Central Committee, and the editorial boards of the Sacramento Bee and Mountain Democrat – all opposed Measure E not only because it was unlawful, as the court has now confirmed, but because its broad brush approach impacted smaller projects, job-generating commercial, business expansion, agricultural uses, hospitals and medical facilities, parks and ballfields, and moderate income housing.

The court’s decision invalidating Measure E’s unconstitutional amendments will restore underlying General Plan policies from voter-approved Measure Y requiring new development to pay Traffic Impact Mitigation (TIM) fees to fully mitigate traffic impacts.

Measure Y is working to maintain levels of service on our roads. The TIM fee program, which has generated over $240 million in road improvements to date, is the most expensive and comprehensive regional road improvement program in the state. It is the only program designed to maintain levels of service on both local roads and state highways, including Highway 50 and interchanges. A 2015 nationwide fee survey shows El Dorado County TIM fees are the highest of all 280 jurisdictions surveyed – more than six times the national average, and 75% above the next highest reported city or county in California.

In a 2014 report to the Board of Supervisors, County staff and counsel acknowledged that Measure E raised constitutional issues that would need to be addressed if the measure was approved by voters. After the election, the County was between a rock and a hard place – it was required to enforce Measure E by either imposing unconstitutional conditions on new projects, or unconstitutionally denying a permit because the condition couldn’t be lawfully imposed. EDCARP decided to file its own lawsuit to ask the court to resolve the important constitutional rights of property owners, small businesses, farmers and ranchers and others in our community.

In addition to invalidating Measure E exactions that exceeded federal and state constitutional and state law requirements, the court’s detailed 49 page opinion upheld a handful of implementation measures that were already being applied under the TIM fee program and several other clauses amended to reinstate 1998 Measure Y language. Measure E revoked a 2008 voter amendment to Measure Y authorizing the Board, by a 4/5 vote, to add a road segment to the list allowed to operate at LOS F - authority the Board has never exercised. Changes regarding multi-family housing were found not to be inconsistent with the Housing Element, because after invalidating other unconstitutional conditions, traffic impacts can be mitigated by payment of TIM fees. A new policy requiring a 2/3 vote to form an Infrastructure Financing District (IFD) was upheld because it simply restated existing state law and applied only to IFDs.

When I helped out at a children’s activity centre we were trained relentlessly to spot the signs of child abuse. Often the signs are subtle – shoes too small with toes clenched inside or callouses on young feet; regular complaints of a sore stomach when actually no breakfast or dinner was provided; handwriting never good enough, or lies told to avoid being reprimanded.

But life is far more a series of little events that could be mistaken for anything and passed off as day to day. Warning signs for children at risk can be well hidden not only from our view but also from theirs. 

A quiet child – the most significant pointer of something going wrong – is often overlooked. Quiet means good. A room full of quiet children allows you to be in charge. So I was unprepared when one of the quietest children finally couldn’t keep quiet any longer.

It was written all over her face. All the spark had gone out of her eyes. She looked tired, as if she hadn’t had any sleep. As I passed her table I casually asked if she was OK. A tear rolled down her cheek. I invited her to come outside where she could have some privacy.

I remember her looking down at the floor. I asked if there was anything I could help with. She shook her head and in fact she was correct. In that moment, I sensed whatever it was would not be revealed to me, so I gently said: “It’s OK. You don’t have to tell me anything. I’m not nosy. But is there someone you do trust who you would like to talk to?”

Her eyes shot up and met mine for the first time. I’ll never forget that look – it was a gaze of total empowerment. This was her chance to make it stop, once and for all and she took it. “Yes. I’d like to speak to a social worker.”

They talked for hours. She didn’t go home that night. That was some years ago now. I saw her in town laughing with her friends the other day. I’m so glad she found her happiness and sparkle again.

After that, I realised the importance of never ignoring my intuition. I could easily have overlooked that inward reticence or given up enquiring when she declined my help. I’m often reminded of the motto of the group that trained me – “we will be and do for these children as we would for our own”.

It moves me every time. I have no children of my own, but you can count on me to protect their wellbeing as if they were. A society with no tolerance for abuse looks like this: everyone’s children are your children.

Parking in Placerville -- Words by Wendy

PARKING in Downtown Placerville…It’s a new system with increased hours and cost, and it is sparking heated debate and angry concern among merchants and the community.

We acknowledge there are challenges.  We’d like you to know we’re working on them.

Staff will provide the City Council with an update on the Parking Program on Tuesday, August 8th although we are fully aware of the conversation and concerns of the community. In addition, the Parking Committee has been interfacing with Staff on this issue and they will be working with the merchant community to fully understand the problems while they collaborate on potential solutions. I have no doubt that we are in a period of transition and that the current parking program can be tweaked successfully.  We can figure this out!

As I have been challenged to think critically about this issue, here are some ideas I’ve found helpful:

ACCEPT “WHAT IS”.  We have a new parking program. It’s totally different. People are confused about it. There are problems with it. There are also critically important reasons for some of the changes. The task before us is to acknowledge all of this, without extreme emotion, so we can employ rational thought to the challenge.  We can’t go back to where we were, so the next step is to accept “what is” at this moment in time so we can move forward productively.

Then what?

OBSERVE AND DECIDE.  (I think we’re right in the middle of this course of action.)  We are observing how the current Parking Program is working and are understanding what the exact problems are that need to be addressed.  I also found it helpful to realize that just because a program isn’t perfect right off the bat doesn’t mean it should be immediately discarded. Life is full of trial and error. Action and redirection. It’s kind of like parenting. No one does it perfectly from the get-go. You make mistakes. You try something new, see how that works. You get better as you go. It’s as simple as that. As for parking, we’ll talk to each other and understand what exactly isn’t working for the customer, the merchant, the employee, the taxpayer, and then we’ll decide on potential solutions.

EMBRACE CHANGE.  (This is an area we tend to struggle with as a community). It is important to understand we had to change the old parking program. Did you know that the old meters were broken?  Did you know they were so old that parts were not available and that the company was no longer servicing them? Did you know that the $1 per hour fee for parking had stayed the same for over 10 years? Did you know that the old Parking Program wasn’t paying for itself and that NO money was being set aside for the repair and maintenance of our parking garage and parking lots? We had to make a change…it would have been irresponsible not too.

So here we are.

The Parking Program has some challenges. What initial effort doesn’t? We don’t need to be completely undone by this fact. Our response doesn’t have to be a knee jerk reaction like “I’m never shopping in Placerville again!”.  We can make productive changes to the Parking Program which ensure that our customers have adequate parking, that our merchants and the taxpayers are not unduly burdened, and that we have the resources we need to maintain our parking facilities.

My goodness, if we can tame the Wild West, we can tweak our parking program!

Renowned Viticulturist Guest Speaker at El Dorado Wine Grape Growers Meeting

Renowned Viticulturist Stan Grant to discuss key elements of vineyard management during the ripening phase.

While wine grape vineyards are intensely managed early season and mid season, this not the case after veraison.  During the ripening period, wine grapes typically receive irrigations, but little else.  It is, however, a period rife with viticultural risks.  The most common ripening period risks for grapevines include tissue damaging stresses associated with water, heat, sunlight, and potassium.  The nature of these risks, strategies to manage them, and tactics for very high temperatures are the topic of the presentation Ripening Period Vineyard Management.

The El Dorado Wine Grape Growers will be sponsoring this event at their August 17th Meeting, 6:00pm at The Veterans Hall, 130 Placerville Drive, Placerville 95667 CA. This event is free to attend.

Pato Banton comes to Shingle Springs Community Center

In a concert to benefit the developmentally disabled is billed as, "Coming Together" and will be at Shingle Springs on Friday Sept. 22, 2017.  

Banton's debut album was the 1985, Mad Professor-produced Mad Professor Captures Pato Banton, followed in 1987 by Never Give In, which included a collaboration with Paul Shaffer and a follow-up to his earlier collaboration with ranking Roger with "Pato and Roger Come Again"

More recently, Banton has been playing with Mystic Roots, a reggae band formed in Chico, California.

With the release of his new album “Destination Paradise” Pato Banton is embarking on a musical and spiritual mission across all 50 States of America. At the beginning of this mission Pato decided to create a new band called “The Now Generation” made up of different members from the LA/OC area of Southern California.

El Dorado Hills Teens Start 1,300 Fire Burning "Illegal" materials

Two El Dorado Hills men have been arrested and charged with recklessly causing the fire that burned nearly 1,300 acres near Rancho Murieta last week, Cal Fire announced Friday afternoon.

The fire, called the Latrobe Fire, ignited around 2:45 p.m. July 26 near Latrobe Road and Scott Road. The blaze burned for several days and was 100 percent contained by Friday afternoon.

Cal Fire enforcement officers, working with the Sacramento County district attorney's office, announced Thursday's arrest of Jacob Place and Maxwell Goldsworthy, both 18. The Sheriff's Department website says the two were released Friday.

Brice Bennett, an information officer for Cal Fire, said the two are charged with unlawfully causing a fire, a felony. 

He said the two were burning illegal materials off Latrobe Road, but he wouldn't specify what the materials were. 

Asked for any particulars of the fire – if, for example, it was a bonfire – Bennett said, "It was 2 o'clock in the afternoon or so, near a hundred-degree day, so who needs to be having a bonfire?"

"Rural road systems are not an area where individuals should gather and hang out and socialize," Cal Fire spokesperson Brice Bennett said. "This is an area that's unsafe for these activities and it's just not a good idea."

Cal Fire has issued several citations to people who are now being investigated by the district attorney's office.

"Make the right decision: Don't burn illegal materials, don't partake in illegal activities," Bennett said.

Both teens have been released from the Sacramento County jail.

Former El Dorado Hills Man Sentenced to Prison for Tax Evasion

SACRAMENTO, Calif. — Kamyar “Kami” Soltani, 47, of Sacramento, formerly of El Dorado Hills, was sentenced today by U.S. District Judge Garland E. Burrell Jr. to six months in prison, six months home confinement with electronic monitoring, and ordered to pay $150,446 in restitution for tax evasion, U.S. Attorney Phillip A. Talbert announced.
 
“All Americans have a duty to pay their fair share,” said Michael T. Batdorf, Special Agent in Charge, IRS Criminal Investigation. “Soltani took advantage of the system and obtained refunds to which he was not entitled while all along living a lavish lifestyle. In today’s economic environment, it’s more important than ever that the American people feel confident that everyone is playing by the rules and paying the taxes they owe.”
 
According to court documents, Soltani attempted to evade his tax obligations for tax years 2005, 2006, and 2007. Soltani worked in the used car sales industry. In each of the tax years in question, Soltani received taxable income between $229,000 and $296,000 and failed to file timely income tax returns for the tax years of 2005 and 2006. He ultimately filed tax returns for all three tax years in March 2008, but those returns only reported income of approximately $14,000 to $18,500 in each year. As a result of his conduct and tax filings, Soltani evaded $150,446 in federal income taxes, paid no taxes for those years, and in each year fraudulently claimed and received tax refunds of over $2,000 by falsely claiming that he was entitled to an Earned Income Tax Credit reserved for taxpayers with low and moderate income. Soltani admitted he acted willfully to evade taxes, in part, through his filing of false tax returns and by receiving his income in the form of cash and through indirect payments made to third parties.
 
This case was the product of an investigation by Internal Revenue Service, Criminal Investigation. Assistant U.S. Attorneys Nirav K. Desai and Christopher S. Hales prosecuted the case.

Stand Down Meaning & History

“You don’t leave anybody outside the wire. If you’ve got wounded outside the wire, you go get them, regardless of the cost.”

Stand Down was started with belief in the triumph of the human spirit over extraordinary odds. It grew out of a conviction that the overwhelming number of homeless veterans on the streets of America is unacceptable, and that the veteran community itself must respond.

Stand Down is an intervention that was conceived from the ground up specifically for veterans, by veterans.

The first Stand Down was in 1988 under the auspices of the Vietnam Veterans of San Diego (VVSD) to provide coordinated, comprehensive services to homeless veterans over a three-day period at one site. This service model was designed to bridge many of the physical and psychological barriers between service providers and recipients.

Primary emphasis was placed on the creation of a community in which homeless veterans are treated with respect and given the opportunity to relax, interact and form ties with peers and volunteers while receiving much needed specific services.

Should elected officials be able to block people on Facebook and Twitter? A federal court says NO

Technology forces government to confront all sorts of legal and ethical questions it has never pondered before. The latest example: Should public officials be able to block people on social media? 

A number of elected leaders, including the President of the United States, are facing that dilemma as we speak. Donald Trump was sued in June by a group of people he blocked on Twitter. A Murrieta resident has also complained that Rep. Ken Calvert (R-Corona) wrongly blocked him from viewing the congressman’s social media posts.

Last month, a federal court weighed in on the matter. U.S. District Judge James Cacheris sided with a Virginia man who was blocked by a county supervisor for alleging school board corruption on Facebook.

“Indeed, social media may now be ‘the most important’ modern forum ‘for the exchange of views,’” the judge wrote in his opinion, which could have significant implications for elected leaders at both the federal and local levels. “The First Amendment applies to speech on social media with no less force than in other types of forums.”

But there’s a line between speech and harassment, and it’s one Rep. Ken Calvert’s spokesman Jason Gagnon says is too often crossed.

“In the few instances where individuals post abusive, obscene or threatening messages, they have and will be blocked from our official accounts,” Gagnon said. “Examples of messages that have resulted in individuals being blocked includes obscene personal attacks and messages indicating they hope the congressman dies from AIDS.”

The Press Enterprise began asking around to see how other California politicians were handling the matter. With no set legal standard, it found a discrepancy in responses.

Reps. Adam Shiff (D-Burbank), Pete Aguilar (D-Redlands), and Norma Torres (D-Pomona) reported no blocked users. But Rep. Mark Takano (D-Riverside) said he’ll put the kibosh on anyone who uses “violent, profane or abusive language” on his page. The offices of Mimi Walters (R-Irvine), Darrell Issa (R-Vista), Ed Royce (R-Fullerton), and Duncan Hunter (R-Alpine) did not respond to requests for comment.

So who’s right and who’s wrong? The issue will continue to make its way through the courts but, ultimately, experts say we may need federal legislation to see that question resolved.
