My Turn: Convict Larry Weitzman and his Background Checks

The attention to the details in his recent article attacking me was impressive, and as the end of the story approached, I could almost hear the symphony of cymbals crashing and trumpets blaring as our daring author, the one and only Lawrence Weitzman, reached his grand finale and delivered, with fearless resolve, his juicy climax:  the chairman of the Charter Review Committee has had vehicle registration problems!!! 

Well, ok, maybe it was not so much a satisfying intellectual climax and more of an anemic sputtering after an awkward rant.  But let’s give Larry credit where credit is due: given the level of detail that his research produced, omitting relevant, known facts takes focused and pre-mediated effort.  So, as far as disjointed rants go, this one is pretty good at achieving its purpose, which is not to better El Dorado County or our Charter Review Committee, but to make Cristofer Alarcon look bad. 

What details could have been left out of Larry’s epic tale of vehicle registrations?  One is the fact that the vehicle registration issue was incorrectly charged as a felony, and this was corrected before trial to be charged as a misdemeanor.  Another fact is that at trial, I could have exonerated myself by snitching on the person who I suspected had messed with the vehicle registration—not a member of my immediate family, but young man that was having lots of problems of his own, and a family member nonetheless.  I took one for the team, so to speak, and plead guilty to a misdemeanor.  Finally, there is the matter of my past identity. 

I suppose its time to own up to this, publicly.  So here goes:  YES, I admit I used to be known as Cristofer Price.  YES, I took the name Cristofer Alarcon and have been using that name for many years.   I’M SORRY for having betrayed the taxpaying public by failing to disclose to the Charter Review Committee that in 1969 I was adopted.  

Furthermore, for having taken the time and trouble to gather together the details of my past woes with the DMV and my personal history, I consider Larry Weitzman to deserve the honor of serving on the Charter Review Committee, and so if the circumsatances should come up in the future, I would step down as chair so that the duties of this non-paid volunteer position can be filled by Larry-- just as soon as he passes his own proposed background check.

What Larry missed is that I did pass a State DOJ background check for EDCOE before I served on the Charter Review Committee, and I also passed a Federal DOJ background check before I helped open the Red Hawk Casino.  But I give him some slack on not mentioning this in his story as he was in Federal Prison, and had limited information available to him.

LAWRENCE EDWARD WEITZMAN [#43778], 67, of Rescue was summarily disbarred May 27, 2011, and was ordered to comply with rule 9.20 of the California Rules of Court.

Weitzman was convicted in 2009 of conspiracy to commit money laundering. Because the crime is a felony that involves moral turpitude, it meets the criteria for summary disbarment.

RECOMMENDATION OF SUMMARY DISBARMENT

On November 4, 2010, the State Bar filed a request for recommendation of summary disbarment based on Lawrence E. Weitzman~s felony conviction. Weitzman did not file a response. We grant the request and recommend that Weitzman be summarily disbarred.

On December 4, 2008, Weitzman pled guilty to a felony violation of title 18 United States Code section 371 (conspiracy to structure transactions in violation of 18 U.S.C. § 5324 and launder money in violation of 18 U.S.C. § 1956(a)(1)(B)(i) and 1957). Effective February 9, 2009, we placed Weitzman on interim suspension. On November 4, 2010, the State Bar transmitted evidence that Weitzman’s conviction was final...

The record of conviction establishes that Weitzman’s conviction meets the criteria for summary disbarment under Business and Professions Code section 6102, subdivision (c). First, kwiktag ~ 018 040 455
the offense is a felony. Second, the offense for which Weitzman was convicted involves moral turpitude.

Weitzman conspired to violate title 18 United States Code section 1956(a)(1)(B)(i). The moral turpitude classification of the crime of conspiracy depends upon the object of the conspiracy. (In re McAllister (1939) 14 Cal.2d 602, 603 [if the commission of an offense involves moral turpitude, then a conspiracy to commit the offense would also inVolve moral turpitude].) In order to convict under title 18 United States Code section 1956(a)(1)(B)(i), the Government must prove the defendant "(1) knew the property involved in a financial transaction represented the proceeds of some unlawful activity; [¶] (2) conducted or attempted to conduct a financial transaction which involved the proceeds of the unlawful activity; [¶] (3) knew the transaction was designed in whole or part to conceal or disguise the nature, location, source, or ownership or control of the proceeds from the unlawful activity."...

When an attorney’s conviction meets the requirements of Business and Professions Code section 6102, subdivision (c), "the attorney is not entitled to a State Bar Court hearing to determine whether lesser discipline is called for." (In re Paguirigan (2001) 25 Cal.4th 1, 7.) Disbarment is mandatory. (Id. at p. 9.)

We therefore recommend that Lawrence Edward Weitzman, State Bar number 43778, be disbarred from the practice of law in this state...

When she was a little girl, her mother told her: “Gloria, we trained you to be independent.  But you’ve taken it too far!”  Gloria Kirk Smith, from a long line of independent women, passed away on August 1st about six weeks short of her 95th birthday.
 
She died exactly where she wanted to be, in her home atop Sacramento hill on property that had been with her family for more than a century.  Family was at her side. 
 
Though short in stature, barely more than 5 feet, she had a big heart and was fiercely loyal to her family and the town she loved.  Gloria and her husband, the late Thomas Callan Smith, owned a number of rental properties for more than sixty years.
 
Serving as an early day business incubator, they helped a great many scores of Placerville residents get started in business, made possible because of affordable rent on very attractive terms, like a month to month tenancy confirmed with nothing more than a handshake.  
 
They pridefully looked at their commercial tenants as all but members of the family.  Gloria collected a foot-tall stack of newspaper clippings about their commercial tenants and their successes.
 
They felt the same way about a great many of their residential tenants who with affordable rent were able to save for buying their first home.   Mike Raffety, for example, a long-time editor of the Mountain Democrat, rented his first place from the Smiths when he first came to town long ago to work for the paper that was then located on Main Street next to the Hardware Store. 
 
Gloria asked one of their commercial tenants, John Sanders of the Old Town Grill, “Now, exactly how long have you been here?”  John with a big laugh said, “When I had hair and before yours turned white.”
 
Gloria did the bookkeeping for her husband’s Shell Station on Main Street in the 1950’s.  That’s when she started a very large coin collection of mostly old silver dollars brought back by gasoline customers returning from gambling at the lake. 
 
Later, she worked long hours in the family grocery store, the Drive-In Market at 115 Main Street that had earlier Tom Raley’s first market.  That was a day when you could still know most of your customers.
 
She was an active supporter of historic preservation efforts in town like backing the successful efforts to save the Herrick Building that she remembers was home to the town’s Post Office on the second floor.  
 
Her description of that mail collection spot sounded much like a modern Facebook page, a social hub where, in the absence of rural mail delivery, town folks regularly met their neighbors to keep up on current events; “Hey Joe, got any color in your mine?” or “Sue, how’s the pear crop this year?”
 
In recent years, she complained about post office visits; “You never see anybody you know there anymore.”  Gloria, supporting many causes, and was also one of the major financial backers of the still pending litigation to stop the town’s courthouse from being closed, much as she and her husband joined other members of the business community in the 1970’s to save it from demolition when it was deemed not to be up to earthquake standards.  
 
Gloria often expressed disappointment with city efforts to mess things up, as she saw it, like trying to build a roundabout, selling the old city hall buildings (she remembers when it was used to house the county library), and moving the Druid’s Monument, and blamed those things on “those newcomers.”  

When asked to define newcomers she said, “Anyone who moved here after WWII.”  Her family suspects Gloria’s mother would have said it was after World War One.
 
Gloria supported Measure K nearly five years ago in response the city’s stubborn 8 year-long effort to build a roundabout, signing ballot statements among other things, and told reporters: “It’s an absolutely asinine idea.”   She was never accused of being bashful.
 
Like her mother before her, Gloria learned to drive cars at a young age and was an excellent shot with the long rile her grandfather gave her as a child.    And just as her mother had served our country during WWI, supporting General Pershing’s American Expeditionary Force in France, Gloria served our country during the WWII. That started in the midst of her second year of college and she left to work for the government, teaching factory workers at a vital aircraft plant in Mississippi.
 
Gloria read several newspapers daily throughout her life but slowed in recent years to just one or two.  She had a life-long fascination with old expressions along with their origins.  She collected a number of books on that subject, which may have added to her very long list of “Gloriaisms,” many that cannot be printed.  Apart from family collection of photographs of Placerville, she had one the largest collection of photo postcards of our town.
 
Gloria called buildings in town by their original name, like calling the city's Town Hall the “Purity,” home of a grocery store that occupied that spot many decades before. After finally giving up driving several years ago, she would complain if some shortcut was taken to drive home.  Instead, she insisted on going down Main Street, a place that had no street numbers when she grew up here. 
 
Business listings in newspapers or in the phone book would give only the name of the street, not a number, since everybody knew where to find buildings and people in her early day.   The address for grandparent’s home was listed in the phone book nearly a century ago, not with a street number or even “Coon Hollow Road,” but simply as the “Kirk Ranch.”
 
Why? Because, as she said, if you were from here you knew where everybody was, it was just beyond Simon’s house on the corner and across from the “Simpson Ranch,” home of neighbor Charlie Simpson who delivered mail on Main Street when she was small.  The town changed some since then, but not Gloria, as those who knew her would attest.
 
She was given a pacemaker at Marshall Hospital on May 1st when her pulse suddenly dropped to below 60 beats a minute. That was enough to provide several extra priceless months for her and those nearest to her, although a weakened heart was not expected to last forever.
 
She and her husband rented the building used by Snowline Hospice when it first came to town many to use as their first Thrift Shop and it was Snowline that lovingly provided very valiant and angelic care for both Tom and Gloria, each during their last few weeks on earth. In lieu of flowers, those wishing to pay homage are invited to contribute to Snowline Hospice, a group that keeps giving back so much.
 
Oh, and that photo of her on a horse?  It was taken at the home of a local friend when she was a sophomore at El Dorado High School.  Despite her broad smile of confidence, it was actually her first time on a horse.  And judging from the terrified face of that animal, the horse must have been pleased that it was also her last time riding.
 
 Graveside services are being planned for the morning September 16th at Union Cemetery on B Street.  It is the resting place for a number of generations of Gloria’s family that dearly cherished this town along with its values and history.

Rafael Martinez appointed as EDC Director of Transportation, effective August 19th

(PLACERVILLE, CA) – The El Dorado County Board of Supervisors appointed Rafael Martinez as Director of Transportation, effective August 19th, 2017. He was most recently the Division Manager for Transportation for the City of West Sacramento.

“Rafael has an impressive resume relative to all facets of transportation, including capital improvement, engineering, construction, field operations, traffic technology, and planning,” said Chief Administrator, Don Ashton. “He’s been responsible for managing hundreds of millions of dollars in transportation projects over his career and is a great addition to the County.”

Recently the County reorganized what is now Community Development Services to include directors of three primary departments, of which is Transportation is one. In addition to his work in West Sacramento, Martinez also served as the City of Corona’s assistant traffic engineer and was promoted to transportation manager where he was responsible for planning the five-year Transportation budget, among other duties.

Martinez then held the position of Deputy Public Works Director for the city of Menifee to establish their newly-incorporated Public Works department where he led the operations, inspections, transportation and capital improvement divisions. He was rehired by the city of Corona as engineering manager overseeing the transportation and capital improvement projects divisions.

“I’m excited to utilize my experience to make a positive impact on the residents and visitors who travel and rely upon an efficient well-maintained road system in El Dorado County,” said Martinez. “My years of work in the industry have prepared me for both the internal workings of the department and its staff, as well as the external relationships with the public and elected officials. I’m looking forward to the challenge,” he added. Martinez holds a Bachelor of Science degree in Civil Engineering from California State Polytechnic University, Pomona and is a resident of Shingle Springs.

Court Appointed Special Advocate's Needed in South Lake Tahoe

When children are abused or severely neglected, they must rely on adults to help them obtain justice and services. Who deserves an advocate more than an abused or neglected child? The heart of our program is the Court Appointed Special Advocate (CASA), a specially trained and supervised community volunteer, appointed by a Juvenile Court judge. CASA advocates make a difference in the lives of abused and neglected children by researching and monitoring cases involving children in foster care.

CASA's typically take only one case at a time, allowing ample time to gather thorough information. They build relationships with their "CASA kids" by spending time with them, gathering facts about their life so they can report back to the judge; who can then make a more-informed decision as to what services and support are in the best interest the child. These decisions can have life-altering ramifications.

Placerville CHP Office has new Commander - Lieutenant Matt Stover

The CHP Placerville Office is pleased to introduce our new Commander! Lieutenant Matt Stover joins us from his last assignment at the State Capitol in Sacramento. 

While assigned to the CHP - Capitol Protection Section, Lieutenant Stover was in charge of Field Operations which had oversight of the CHP Mounted Patrol Unit, Hazardous Device Detail (Bomb Squad,) Bicycle Patrol Unit and the CHP SWAT team. 

Lt. Stover also instructed CHP Cadets while assigned to the CHP Academy. Lt. Stover has also worked at CHP Headquarters, and field assignments in Truckee, Santa Barbara and South Los Angeles. 

We welcome the diverse CHP experience Lt. Stover brings to El Dorado County and are looking forward to seeing what ideas he will bring to further our goal of providing the highest level of Safety, Service & Security.

Turning Tragedy Into Triumph - Kacie’s Ride For Hope Ends Run After Raising Close To $200,000 For Victims of Domestic Violence.
 
Kacie’s Ride for Hope to End Domestic Violence turned tragedy into triumph after more than 11 years of educating the community about domestic violence. Pat Barron, his late wife Sharon and a dedicated circle of friends created a legacy that will endure long after the roar of their motorcycles fades from the mountains.
 
In July 2006, 40-year-old Kacie Barron was shot and killed by her ex-boyfriend in the driveway of her Placerville home. Kacie Barron loved riding motorcycles and in September 2006 Kacie’s brother Pat Barron gathered a small group of Kacie’s friends to do a motorcycle run to honor his sister. They decided to ride to Hope Valley which was Kacie’s favorite run. Little did he know that he would turn honoring Kacie’s memory into hope for thousands of victims of domestic violence.
 
Pat established Kacie’s Ride for Hope to End Domestic Violence, a nonprofit organized to host a motorcycle run through Hope Valley every year with the goal of educating the community about domestic violence and raising funds for The Center for Violence-Free Relationships, the agency that helped Kacie as she sought to leave her ex-boyfriend.
 
The ride started small with about 75 riders in 2006, and grew to host over 400 riders in recent years. Kacie’s Ride for Hope was a very popular event that drew in motorcycle riders from all across California, Oregon and Nevada to make the run from downtown Placerville through Hope Valley.
 
Raising close to $200,000 over the past 11 years, Kacie’s Ride for Hope has provided safety and shelter to families fleeing violent homes. The Center used funds raised through Kacie’s Ride to help victims by providing counseling for them and their children, by providing legal assistance to help with custody and child support issues, restraining orders and divorce filings.  Thousands of victims and their children have been helped over the years all due to Pat honoring his sister’s memory.
 
In 2014, The Center for Violence-Free Relationships dedicated their 18-bed safe house to Kacie Barron. Now called Kacie’s House, A Place of Healing, A Place of Hope, it welcomes families fleeing from violence and lets them know that there are wonderful folks in the community that support and care about them. Those entering Kacie’s House hear the fantastic story of how one woman’s struggle ended and how it sparked the creation of something powerful that would bring healing and hope to so many in our community.
 
This September there will be no rumble of bikes roaring to life to remember one of their own whose life was cut short, but there will be memories that last a lifetime for those that helped build a legacy to honor Kacie Barron… and she will live on in the memories of those that come to Kacie’s House broken but leave healed and full of hope.

Tahoe Wellness Outings: A Prescription for “Nature as Medicine”

South Lake Tahoe, CA – Recovering from a major joint surgery doesn’t usually inspire the idea of snowshoeing by moonlight, but that’s exactly what Carol Bennis, age 75, was asked to do during her recovery last February.

Carol had never been on snowshoes before, or hiked at night, but when she heard her surgeon and other patients at a similar stage of recovery would be there, she decided to try it out.

On a clear night at Tallac Historic Site, Carol and twelve other patients joined Barton Health clinicians and Forest Service rangers on a “wellness walk” through the snow. Carol loved the experience.

“This opportunity enabled me to step out of my comfort zone, make new friends, and learn the history of the area from the ranger,” she said. “Lucky me.”

Carol’s winter “wellness walk” and the idea of “nature as medicine” spurred the creation of Wellness Outings, one of Barton Health’s newest wellness programs. Orthopedic surgeon, Stephen Bannar, MD, noticed that, while South Lake Tahoe is surrounded by public land and plenty of opportunities to enjoy nature, his patients were often too nervous to head outside and incorporate physical activity into their recovery.

Research indicates that time in nature lowers blood pressure, heart rate, and cortisol levels. It increases concentration, memory, and attention spans. It has been shown to boost immunity and is particularly beneficial for at-risk populations, such as those recovering from surgery, who often spend less time outside. These benefits were something Dr. Bannar wanted his patients to experience.

“Can I prescribe nature as medicine?” he asked.

Indeed, he can. In fact, there are a number of researchers and medical providers who support this idea. Nature prescriptions have been commonly used in Japan since 1982 to reconnect people with the outdoors. Dr. Bannar and Khristy Gavigan, a registered nurse, saw an opportunity and partnered with the Lake Tahoe Basin Management Unit to provide a unique healing experience for their patients.

“Our idea was to unite health providers with public land managers to facilitate health benefits for those at-risk populations,” said Gavigan. “Partnering with the Lake Tahoe Basin Management Unit rangers provided that interpretive piece where they could support the logistics, help identify the appropriate outings, and deliver a message about the connection between community wellness and ecosystem health.”

Participants were inspired by their experience, not only reconnecting with nature, but connecting with other people. Isolation is often an issue for those who are recovering at home, especially if they’re concerned that they may injure themselves further by heading out.

“Having Barton’s medical professionals on-hand gave folks the confidence to come out and join the walk, whereas they previously may have been worried about leaving home,” said Dr. Bannar.

Though the program just launched, it has already been recognized as an innovative way for the US Forest Service and health care organizations to improve community health. In June, Dr. Bannar, Khristy Gavigan, and partner, Joseph Flower from the U.S. Forest Service, were asked to share their idea at RecX, a conference run by the U.S. Department of the Interior in Washington, DC.

The focus of the conference was “Great Ideas for the Outdoors” and the Barton team shared the successes of the Wellness Outings and the implications for health across the country.

“We need to change our mindset from treating disease to promoting wellness,” said Dr. Bannar. “A prescription for nature can enable accessibility for at-risk groups as well as preventive medicine for other members of the community.”

For Carol, she saw both the physical and emotional health benefits.

“Public lands are special treasures and not to be taken for granted…but appreciated and respected, not only for their beauty, but for their power to heal,” she said. “The land is truly a gift that must be re-gifted to each generation.”

Wellness Outings are scheduled monthly with Barton Health and the Lake Tahoe Basin Management Unit. The comprehensive program includes options for people with chronic or terminal illness, patients recovering from surgery, and at-risk youth. Deanna Lois Hamilton, Sept. 29, 1944 - July 18, 2017

A celebration of her life will be held at 4 p.m. on Saturday, Aug. 26 at Shadowbrook Farm, 1180 Shadowbrook Lane, El Dorado Hills, Calif., 95762.

Deanna passed away peacefully on July 18, after a brief and fierce battle with cancer. She was the loving wife of 54 years to her high school sweetheart, Jarrett L. Hamilton, and sister to William Van Nuys. She was preceded in death by sister Patricia Hopkins. She was beloved mother to Jennifer Donald, Jarrett Scott Hamilton, Danielle Mickelson and Pete Van Nuys; adored mother in-law to Warren Donald, Mary Jane Hamilton, Kris Mickelson and Lori Van Nuys, cherished grandmother to Ashley, Bri, Samantha, Rachel, William, Molly, Jack, Vince, Isabelle, Mallory, Sierra, Lucky, Jake and was preceded in death by Connor.

Deanna was born on Sept. 29, 1944, in Steubenville, Ohio. She graduated from Jefferson Union High School in 1962. Upon her marriage she embarked on many adventures that led to living in Key West, Fla.; San Diego; Columbus, Ohio; Chicago; Cleveland; and Half Moon Bay, where she landed for a bit before arriving in the Sierra foothills.

Along her way she raised a beautiful family that she loved dearly. She was a brilliant business woman having started two of her own businesses: The Gold Mine and Lou Lou’s. Known as Dee or Mrs. H to many, she opened her home to everyone, always offering homemade meals and great conversation. With all her accomplishments, her family was forever her focus and she loved the life she had created with her husband, Jarrett, on their 58-year journey.

She will be forever remembered for her inspiration, her cooking, her company and her love. She will be forever missed.

Labor Union Fight as Red Hawk Casino Looks To Stall Appeal

Law360, New York (August 10, 2017, 8:25 PM EDT) -- The Shingle Springs Band of Miwok Indians urged a California federal judge on Wednesday not to put into effect his decision to compel arbitration in a battle between the tribe's casino and a union, saying the tribe is likely to win its appeal to the Ninth Circuit.

U.S. District Judge Troy L. Nunley ruled on July 12 that the tribe must go before an arbitrator to determine whether its suit against Unite Here International Union, as well as the union's suit against the tribe on claims that the tribe violated a memorandum of agreement when it fired two employees of the Red Hawk Casino for supporting the union, can be handled by an arbitrator.

The Shingle Springs tribe in a motion Wednesday asked to stay enforcement of that judgment, arguing that the "sole intent" of the agreement between the tribe and the union was that the tribe remain neutral on employees' selection of a union, and didn't provide for the tribe to go to arbitration over firing the employees.

An arbitration provision dealing with the discharge of employees is more typically found in a collective bargaining agreement, and it would actually constitute an unfair labor practice under the National Labor Relations Act because it would involve recognizing a union that doesn't represent the majority of employees, the tribe said.

"Because any agreement to [arbitrate] issues pertaining to the terms and conditions of employment would be illegal, the court must refrain from enforcing the arbitration clause under these circumstances," the tribe said.

The Shingle Springs Band filed suit against Unite Here in May 2016, arguing that the June 2012 memorandum of agreement is not a collective bargaining agreement and does not allow the union to arbitrate personnel decisions such as discipline or terminations before it has established majority status.

The union, which filed its own suit in February 2016, accused the tribe of violating the MOA and its provision on neutrality in regard to an employee's decision to join a union, according to its complaint.

Judge Nunley ruled in July that an arbitrator should judge the arbitrability of the dispute between the tribe and the union under the dispute resolution framework set out in the MOA.

The tribe appealed that ruling to the Ninth Circuit on Wednesday and asked the judge to stay his judgment pending the appeal, saying the tribe has a high likelihood of success in the appeal, or at least raises a substantial legal issue to be considered.

Because Unite Here doesn't yet represent a majority of the employees in the bargaining unit at the casino, it only has standing to enforce the tribe's neutrality on the selection of a union, not to try to enforce issues over employee firings that properly belong in a CBA, the tribe said.

Allowing Unite Here to enter into a CBA with the tribe would actually give the union an unfair advantage over other unions, thereby harming the public interest, the tribe said.

Representatives for the parties were not immediately available for comment Thursday.

The tribe is represented by Christopher F. Wohl and Alexandra M. Asterlin of Palmer Kazanjian Wohl Hodson LLP.

The union is represented by Kristin L. Martin of Davis Cowell & Bowe LLP.

The tribe's case against the union is Shingle Springs Band of Miwok Indians v. Unite Here International Union, case number 2:16-cv-01057, in the U.S. District Court for the Eastern District of California.

Camino Company Paid $24,500 to Push Wilton Casino

‘Save our Elk Grove Mall’ Supported by Wilton Rancheria, Region Business Files Financial Disclosure

An independent expenditure committee calling themselves “Save our Elk Grove Mall” filed a financial disclosure statement for the six month period June 30, 2017 with the Elk Grove City Clerk’s office last week.

The California Form 460, which was recorded August 1, listed two major non-monetary donations. Those two donations were from the Wilton Rancheria and Region Business and were valued at $24,650 and $1,750 respectively.

The Wilton Rancheria is currently pursuing the development of a 2,500 slot machine $400 million casino within Elk Grove City limits with the help of its Las Vegas-based financier, Boyd Gaming. Region Business has been one of several local business groups and elected officials who have been advocating on behalf of the Wilton Rancheria for the project, which is proposed to be located on a portion of the moribund Outlet Collection at Elk Grove.

According to the filing, the Wilton Rancheria’s donation was a payment of $24,500 to Camino, Calif.-based Moore Methods Inc. The donation was described as a survey of registered voters. 

Region Business’ donation of $1,750 was for payment to Bagatelos Law Firm in San Francisco. The expenditure was described as petition gathering services.

The disclosure form also notes that the Save Our Elk Grove Mall carries debt of $28,904 as of June 30. The two largest creditors of the committee are expenditures for Moore Methods and Bagatelos Law Firm.

The statement also includes the longer name for the committee. That name is “Save Our Elk Grove Mall, major funding provided by Wilton Rancheria, supported by a coalition of Elk Grove’s Outlet Collection Mall Developer The Howard Hughes Corporation, Region Business Inc. – Sacramento’s regional business association, Native Americans, local businesses, community citizens ad groups all supporting the economic welfare of the City and Citizens of Elk Grove.”

New Assistant Principal at Camino Elementary School and Camino Polytechnic Charter School

The Camino Union School District would like to announce the selection of Deborah Atkins as the new Assistant Principal of Camino Elementary School and of Camino Polytechnic – A Science and Natural Resources Charter School (previously known as Camino Science and Natural Resources Charter School). “I am honored to have this opportunity to serve the students, families, and educators of Camino Union School District,” Atkins expressed. “I look forward to promoting the exciting educational opportunities that the district offers through Camino Polytechnic and the traditional school.  The science and natural resources charter offers a choice for almost everyone, from a home school option, to a hybrid program where students attend a few days a week, to a full on-site program that is focused on hands-on learning.” 

Atkins brings with her a wealth of experience and training including credentials in Administration, Reading and Literacy Leadership, and Multiple Subject Teaching with a Supplementary Subject in Business. She has a strong reputation for setting high expectations for academic achievement for all students and has a proven track record of her ability to engage parents and community partners in supporting school activities.

She began her teaching career in 2004 with the Los Banos Unified School District, teaching Kindergarten, first, and third grades as well as working as a Reading Intervention Specialist. While there, she piloted one-to-one devices with her students and helped to implement the school district’s technology initiative.  Atkins is most proud of her role as the organizer for the school’s Agriculture Awareness Day, an annual event that brought the farm to school, along with 4-H, FFA and community business members.  “Coming from the central valley, I was delighted to discover the strong connection Camino has to agriculture and the natural resources that are so abundant in El Dorado County.”  

Prior to coming to Camino, Atkins worked with the Folsom Cordova Unified School District as a Title I Academic Coach. In this role, she served as the site program monitor for federal and state compliance monitoring; advised the administrative team on instructional strategies; implemented newly adopted ELA curriculum; and provided guidance on best practices for designated and integrated ELD strategies. She also diligently worked to build stronger relationships with ethnically diverse families through various means such as the English Learners Advisory Committee, the PTA and community volunteer programs.

Jerry Mills pled “no contest” to Beating Female Homeowner Unconscious

On October 23, 2016, a resident of the City of Tahoma was having a small outdoor party at their home. This party was attended by local resident Jerry Mills. During the party, there was an argument between Mr. Mills and another partygoer. In an effort to defuse the situation, the homeowner stepped between Mr. Mills and the partygoer. Mr. Mills then focused his attention on the homeowner and started arguing with her. During that argument, Mr. Mills punched the homeowner in the face twice, knocking her unconscious after the second punch. The homeowner suffer bruising and a concussion.

On August 8, 2017, Jerry Mills pled “no contest” to violating Penal Code section 243(d); Battery with Serious Bodily Injury. Mr. Mills was found guilty by the court and sentenced to 180 days in the El Dorado County Jail, placed on formal supervised probation for a term of 4 years, and will have to totally abstain from the use of alcohol during the term of probation. 

A Criminal Protective Order was issued naming the homeowner as a protected party.

This case was prosecuted by Deputy District Attorney Casey Mandrell.

Calaveras Auditor and Sheriff at War over $120,000 in Cannabis Funds

Under the urgency cannabis ordinance approved last year, cannabis fees in Calaveras County are supposed to be spent on specific items related to enforcement of the program. But on Tuesday, Calaveras County Auditor Controller Rebecca Callen said Sheriff Rick DiBasilio had misspent more than $120,000 of that money, using it instead for criminal investigations, bookings, and other expenses unrelated to the ordinance.

Callen called the revelations embarrassing.

“It jeopardizes and tarnishes the county. It shows the county’s lack of ability to properly handle funds.”

As a result of the sheriff’s actions, the county is now at serious risk of litigation, she added.

DiBasilio disputes the auditor controller’s findings and says the funds were not misspent. But even after a closed session on the subject, Callen did not waver.

“I hope for a corrective action,” Callen said.

This is just the latest controversy to arise over the 2016 urgency ordinance that allowed for cultivation of commercial marijuana in the county. Many are unhappy with the direction things have taken since then and Calaveras -- now brimming with marijuana -- is considering an outright ban on commercial cannabis.

First Bird Tests Positive for West Nile Virus This Year

(PLACERVILLE) – El Dorado County health officials received confirmation this week that a bird found in the South Lake Tahoe area of El Dorado County has tested positive for West Nile virus, the first for 2017. The bird, a Stellar’s Jay, was found on July 31st.

So far this year, West Nile virus activity has been reported in 28 California counties, including neighboring Sacramento and Placer counties. There have been four human cases of the virus reported from Kings, Kern, San Bernardino and Los Angeles counties.

Confirmation of the first West Nile virus positive bird means the virus is circulating between birds and mosquitoes and there is heightened risk of infection in humans. It’s important to take precautions. Last year, four West Nile virus positive birds were identified in El Dorado County on the western slope.

One human case was reported.

West Nile virus can be transmitted to people through the bite of an infected mosquito. Mosquitoes get the virus when they feed on infected birds. The illness is not spread from person-to-person. While most people infected with the virus show no symptoms, some may have high fever, severe headache, tiredness and/or a stiff neck that can last several days to several weeks. The most serious cases of West Nile virus infection can lead to encephalitis, an inflammation of the brain, which can be fatal.

Mosquito surveillance programs are in place throughout the County. Activities include trapping and identifying mosquitoes, treating neglected swimming pools, and reporting and testing dead birds. The El Dorado County Public Health Division conducts human surveillance activities and health care providers are asked to routinely test human cases of viral meningitis and encephalitis for West Nile virus.

The following tips are given to help prevent West Nile virus:

- Drain standing water around the property and keep water in swimming pools, ponds and water troughs circulating or treated with "Mosquito Dunks" or mosquito fish.

- Apply insect repellent that contains DEET or another approved substance (e.g. picaridin, oil of lemon eucalyptus or IR 3535) on exposed skin when outdoors.

- Dress in long sleeves and pants when outdoors among mosquitoes. Mosquitoes are most active at dusk and dawn.

- Make sure doors and windows have tight fitting screens, kept in good condition.

- Report dead birds and tree squirrels to the State West Nile Virus hotline at (877) WNV-BIRD (877-968-2473) or online at www.westnile.ca.gov. Wear gloves and place the dead bird or squirrel in a double plastic bag if you dispose of it yourself.

Ag Responds to Measure E Ruling with "Stay the Course"

STATEMENT OF AGRICULTURE, BUSINESS AND COMMUNITIES OF EL DORADO (ABC-ED)

In 2016, ABC-ED stood up in public and warned that Measure E was illegal and would strangle El Dorado County’s economy.  We said that traffic-control Measure Y, approved by 72% of the voters in 2008, was working and should continue as-is

The small group who wrote and promoted Measure E didn’t like that at all.  They attacked ABC-ED members personally, and called us “tools of developers”.  They insisted that their wholesale re-write of Measure Y was the only answer to “save our county,” and they persuaded just enough people that Measure E barely passed last November.

We’re not developers or their tools – we are farmers, businesspeople, and residents who love El Dorado County. We want it to thrive, and we reject name-calling and political extremism.

Guess what?  We were right about Measure E.  Judge Stracener of the El Dorado Superior Court recently invalidated its key policies as unconstitutional and unlawful.  He said that the Measure E policies would impede County government, create inconsistencies in the County General Plan, coerce County property owners, and take private property rights without due process.

Measure E’s boosters are busy spinning their resounding legal defeat as a victory in social media, and are most certainly hatching new plans to further their agenda.  Don’t be fooled.  Measure Y has produced more than $240 million in developer fees to maintain and improve the level of service on both County roads and Highway 50.

Let’s put aside illegal and poorly written initiatives and stay the course with Measure Y – it’s thought out, well constructed, reasonable and has worked for El Dorado County since 1998.
